Man Faces Murder Charges in Store Clerk Obi Obionamichi's Death

Up to 30 witnesses may be called in the trial of a man accused of killing a store clerk over a $5 t-shirt in 2008. 

A jury will have to decide whether witnesses identified the wrong man or if Antoine Wimes was the shooter who gunned down clerk Obi Okure Obionamichi at a southwest Atlanta convenience store in July of 2008.

In opening statements the prosecution and defense painted very different pictures of the defendant. The defense attoey Ash Joshi told jurors Wimes -- who was 16-years old at the time of the murder -- was 30 minutes away in south Fulton when the shooting happened.

But prosecutor Clint Rucker says he'll call witnesses who place Wimes at the crime scene. Also expected to testify is 22-year old Nikki Kneely. Wimes was out on bond on murder charges when he allegedly shot Kneely and beat her 1-year old son in august of 2009.

The prosecution said Wimes told her he needed money to get out of town and shot kneely when she told him she didn't have any.

Albert Hugley -- one of the first witnesses called to the stand by the prosecution -- says he saw the shooter flee the store that night, but couldn't say with certainty it was Wimes because he didn't see the shooter's face

Wimes will be tried on the charges from the 2009 home invasion case next month.
