Family of slain mother may be moving out of state

The husband of a Gwinnett County mother killed last summer could be planning to move out of state with his two young daughters.

A search party found the body of Nique Leili, 44, in a wooded area near her Lawrenceville home in July.

So far, her husband, Matthew Leili, is the only suspect named in her death.

"Not only had they lost their daughter, and I not only have lost my sister, but they lost two of their grandchildren also. I've lost my nieces," Amy Elk, Nique Leili's sister, told Channel 2's Kerry Kavanaugh.

Elk said she's seen her two young nieces only once since their mother's death.

Police ruled Nique Leili's death a homicide, but to date, police have never filed any charges.

Monday, Kavanaugh found two moving trucks in the driveway and boxes on the curb outside Leili's home. Elk believes Matthew Leili could be moving the family Vermont.

"To just be completely isolated from their mother's whole family, I fear what that's going to do to them emotionally," Elk said.

Gwinnett County Police said they are actively investigating the case on a daily basis.  They said Matthew Leili is still a suspect, but they do not have enough evidence to charge him or anyone with his wife's death.

"As far as restricting his movements, we don't have any right or reason to do that right now," Gwinnett police Cpl. Jake Smith said.

"There is no recourse," Elk said. "We feel very helpless."

But there is a court order obtained in January.  The judge wrote that cutting off the children from their grandparents would result in "emotional harm to the children". 

The court order outlines visitation for Nique Leili's father and step-mother to see the girls and it spells out guidelines in the event the family moves to Vermont. It said Matthew Leili will provide his address and telephone number upon his relocation.

Kavanaugh went to the Leili's home on Monday. A man responded through the door saying "I have nothing to say."  Attempts to reach Leili's attoey were not successful.
