Teen Chase Culpepper suing the DMV after being refused driver’s licence photo with make-up

Earlier this year, Chase Culpepper went to collect his driver's licence from the department of motor vehicles.

Before he had his photo taken, he was asked by staff to remove his make-up because it could be considered a disguise.

The 16-year-old, of Anderson, South Carolina, is male, however he identifies as gender non-conforming.

Now, the Transgender Legal Defense and Education fund is filing a lawsuit on behalf of Chase.

According to WYFF, the case argues that denying Chase the freedom to wear his everyday makeup in his licence photo constitutes sex discrimination and violates his right to free speech and expression under the United States Constitution.

Chase argues that a photo of him without make-up is more of misrepresentation of himself than a photo of him wearing it.
