Kelvin Lewis Odom, 50, was arrested and charged with first-degree child cruelty for allegedly attacking his newbo so severely that he fractured the baby's skull which led to the baby's death.
Odom was the only adult at home in his Water Vistas Parkway apartment near Lawrenceville, Atlanta, Georgia, when the baby was injured.
Four other children, ranging in age up to 14, also lived in the apartment.
According to police, officers responded to a 911 call that the baby was having difficulty breathing. Odom made the call from the apartment at 4.30 pm on September 2.
The child, however, resumed breathing and 'appeared normal' by the time authorities arrived.
Odom was asked by paramedics whether he wanted to have the child transported to the hospital but said he did not want too, police said.
Gwinnett County police spokesman Cpl. Deon Washington told The Atlanta Joual Constitution: 'He declined to have the child transported by ambulance.'

About three hours later, the child's mother came home from work and noticed that the newbo was having difficulty breathing and was discolored, Washington said.
Odom told the child's mother that the baby had 'fallen off the couch and landed on the floor.'
The couple then drove the tot a short distance before they called 911 again.
The baby was then taken by ambulance to Children's Healthcare of Atlanta.
There, doctors discovered the newbo had a fractured skull and closed head trauma, police said. He later died from his injuries.
An autopsy is underway and will determine if further charges will be filed against Odom.
The Division of Family and Children Services is also staging an investigation.
