Attoeys say a North Georgia judge pulled out his gun in open court while a witness was testifying, a move the prosecutor says was "totally inappropriate."

The Atlanta Joual-Constitution reports that District Attoey Jeff Langley said Saturday the incident in Lumpkin County Superior Court has been referred to the state Judicial Qualifications Commission, which investigates judicial misconduct.

Langley and another attoey told the newspaper Superior Court Judge David E. Barrett drew his pistol on the bench Wednesday as a woman testified about being assaulted. Langley says the judge appeared frustrated when the witness became uncooperative and offered her his gun, saying, "You might as well shoot your lawyer."
