Donnetta Foster, a DeKalb County mother, was arrested after her baby cooed at a Decatur library.

DECATUR, Ga. - A DeKalb County mother says she was arrested after her baby cooed at a Decatur library. Donnetta Foster went before a judge on Wednesday to get the case thrown out, but police told a different story.

Two Decatur police officers told a judge that Foster became belligerent after being thrown out of the library. They told the court the young mother was arrested for using profanity in front of children.

Foster says she and her son, Savon, were kicked out of the downtown Decatur library because the then 1 year old was cooing. Decatur police agree with that part of the story.

Police issued foster a criminal trespass waing. They say she left the library, then headed over to the Presbyterian Church next door and called the media. Two officers testified that the crying mother became irate and started using profanity.

Foster's mother also came to the scene. She testified her daughter was not cursing and police were throwing their weight around.

The judge denied Foster's motion to dismiss the case, and told attoeys a jury should decide if the disorderly conduct charge should stick.

The solicitor's office told the court they have an audiotape of Foster's arrest. They admitted they have listened to some of it, but they have yet to hear the profanity.
