Ala. Man Mark Duke Charged in 4 Killings Appeals

ATLANTA - An Alabama man who was sentenced to life in prison without parole for the murders of four people is asking a federal appeals panel to reverse his sentence.

Mark Anthony Duke's attoeys asked the 11th U.S. Circuit Court of Appeals on Friday to toss his conviction because they say the prosecutor negatively questioned Duke's decision to stay silent at trial.

Alabama attoeys countered that it was a harmless error that didn't impact the outcome of the case.

Duke and another man were sentenced to death for fatally shooting Duke's father, his father's fiancee, and cutting the throats of her 6- and 7-year-old daughters when the two ran out of bullets. It was downgraded in 2005 when the Supreme Court ruled he couldn't be executed because he was 16 at the time of the killings
