Top Georgia Court Overturns Rape Conviction of James Odell Hobbs

ATLANTA - Georgia's top court has overtued a rape conviction against a Cherokee County man.

The Georgia Supreme Court's 4-3 opinion Monday found that the trial judge gave insufficient instructions to the jury that convicted James Odell Hobbs in October 2005.

Hobbs was sentenced to 20 years in prison after he was found guilty of rape, aggravated child molestation and other charges.

The court concluded that the trial judge improperly told jurors how they could consider good character evidence that Hobbs' defense attoeys presented.
