Lilbu police have charged a nursing assistant who allegedly punched a 75-year-old resident in the face, breaking her nose.

Elizabeth Diaz, 75, suffered a broken nose and bruised face at the hands of a care giver at the Pruitt Health facility in Lilbu.

The woman's son, Pedro Jesus Diaz, said his mother is in pain, suffering from a broken nose and bruised face. Lilbu Police said a caregiver at the facility, Joan Malcolm, was charged with battery. In this case investigators said the charge is a felony because the battery occurred at an assisted care facility.

Investigators said a confrontation occurred between Malcolm and Diaz occurred shortly before Diaz was injured. Mr. Diaz said no matter what happened that led to the confrontation, it's up to the care giver to be qualified and able to work with and calm down residents.

He said his mother was injured last Friday, Christmas Day. Diaz said family had visited with Elizabeth Diaz the night before, Christmas Eve. Diaz said he leaed of the injuries at the next visit, last Sunday.

Lilbu Police arrested Joan Malcolm on Thursday. Jail records show she bonded out by Friday.

Diaz said his mother is in the assisted care facility for complications from diabetes and other health issues. He said he hopes his mother’s case will send a message to other health facilities to properly screen employees.

Diaz said he is working on having his mother moved to another facility but so far has had a tough time finding another place with the bed space.

He said he has retained an attoey to consider his next legal option.
