Injured Botanical Garden Worker Johnathan Scott Sues in Collapse of Garden'S Canopy Walk
ATLANTA - A fifth person has filed a lawsuit against the Atlanta Botanical Garden for injuries he suffered when an elevated walkway he was helping to build collapsed.
Johnathan Scott filed suit in Fulton County State Court on Wednesday, nearly 2 years after the collapse.
The Canopy Walk, which gives visitors an aerial view of the garden, collapsed on Dec. 19, 2008, dropping workers as far as 40 feet to the ground. One person was killed and 18 were injured.
The widow of a 56-year-old construction workers and three injured workers filed similar lawsuits in May 2010. Scott accuses the botanical garden and nine companies of negligence and failure to protect workers who were building the elevated walkway, calling the pathway "inherently dangerous."
