Police investigate shooting at Kroger on Ponce De Leon Avenue

Surveillance video shows a black BMW backing into a Kroger parking spot next to a construction company truck.

A man in yellow steps out, then the driver makes an appearance too.

We don't see the murder which police say was recorded, but according to Jason Shelton, he and a coworker cleaning a bridge on the beltline, spotted the man getting into their company truck.

He says they both approached the vehicle and he says the victim slapped the driver's window which resulted in the gunman firing from inside the truck.

"All I saw was a gun come up and boom shot him. I'm assuming he was trying to steal the vehicle", said Jason Shelton.

Atlanta police released surveillance of a black BMW 3 series fleeing the scene.

Homicide Commander Lt. Charles Hampton says they need the public's help.

"Dark tinted windows, sunroof and possibly a drive-out tag... So we're asking anyone if they see that vehicle to give us a call", said Lt. Hampton.

The fatal shooting did not help an attempted re-rebranding of the Kroger as the ”Belt Line Kroger. Many customers like Danielle Pautler know it as something else.

"I was like ‘Oh gosh, another murder at murder Kroger is this happening again'", said Paulter.

She and other area residents told us this Kroger has the unenviable nickname because of crime in the area.

Jason Shelton says he and co-workers, including the victim, discussed safety before coming to the jobs site.

"I actually asked another superintendent if I could borrow his weapon", said Shelton.

He also says the victim had left his weapon in the truck.

Kroger told us their condolences are with the victim's family and that they are focusing on supporting police to apprehend the perpetrators of this tragic crime.

"It's just very, very sad. Hell of a good guy, four kids", said Shelton.

He tells us the victim was from Alabama, was married and had four children.

His name has not been released.
