Ex-Correctional Officer Benjamin Montgomery, Admits to Inmate Assault

ATLANTA - A former correctional officer at the federal penitentiary in Atlanta has pleaded guilty to charges that he assaulted an inmate and wrote a false report about the incident.

Benjamin Montgomery faces a maximum sentence of 10 years in prison on the deprivation of rights charge and 20 years in prison on the obstruction of justice charge, both civil rights violations. Each count also carries a maximum fine of $250,000.

Authorities alleged Montgomery physically assaulted an inmate and then falsely accused the inmate of making aggressive movements towards him in a memo to his supervisor in an effort to impede the investigation of the inmate’s complaint.

Montgomery is scheduled to be sentenced on Feb. 24.
