A Fulton County magistrate judge has dropped charges against a high school principal accused of simple battery on a student.

Tim Duncan, the principal of Chattahoochee High School, was accused of shoving student Calvin White into the wall during a confrontation at the school on Sept. 25.

At a probable cause hearing Wednesday, White testified he was volunteering at the school for the "Taste of Johns Creek" event when he encountered Duncan, who he says angrily pushed him.

"I was shocked," White testified.

Fulton County school police Capt. Richard Newman told Judge Victoria Moran after reviewing surveillance video of the incident and talking to witnesses, he felt there was probable cause to charge Duncan.

Duncan, however, testified that he saw White and others running through a hallway where they shouldn't have been, and that he was merely trying to maintain order and a safe environment.

He testified that he placed his hands on White's shoulder and calmly told him he had to leave the building.

Moran took just a few minutes to dismiss the case.

Afterwards, White and his mother declined to comment to Channel 2's Mike Petchenik.

Duncan's defense attoey, Vic Reynolds, told Petchenik his client was thankful for the decision.

"Mr. Duncan's very pleased, very relieved," Reynolds said. "He's looking forward to getting back to work tomorrow moing at Chattahoochee High School."
