Police have arrested a homeless man accused of biting off part of a waiter's lip. Carl Winston faces a charge of aggravated battery.

Police say Winston attacked Rodney Scott when Scott stepped outside the midtown Flying Biscuit for a smoke break. Authorities say that earlier, Scott had asked Winston to leave because he was asking restaurant guests for food and money.

Winston is being held in the Fulton County Jail.
