16-Year-Old Son Charged In Crash That Killed His Mother

COBB COUNTY, Ga. -- A man is grieving his wife's death after a fatal car crash last week. He said his son is being unfairly charged in her death.

16-Year-Old Charged In Deadly Accident

Kimberly Nichols, 45, was killed April 13 when her 16-year-old son was driving the family’s Volkswagen convertible to an orthodontist appointment. Police said the teen, a new driver, was making a left tu from Dallas Highway onto Old Hamilton Road.

”It was green. There was a box truck on the other side tuing also. They eased up. They both looked. She told him to go. He looked. They went," Nichols’ husband, Michael Mosley, said.

Mosley said his son then saw two cars coming that he couldn't see past the box truck. One car clipped the back bumper. The second slammed into the passenger side of the Volkswagen, killing Nichols.

Accident

On Tuesday, the family found out the 16-year-old faces second-degree vehicular homicide charges in the crash. With his son standing silently by his side and photos of his wife in hand, Mosley disputed the charges.

"It makes no sense for them to try to bring homicide charges on a 16-year-old boy that's making a tu and done it legally. It's a green light. He yielded. That's all he could do," Mosley told Channel 2’s George Howell.

He said in addition to being unfair, the charges come at a bad time.

"I don't know why I have to find this out at the last minute, and I have to tu him in in the moing, for him to listen to charges on his mother. We just got over a funeral for her. And he's trying to start to heal just a little bit," Mosley said.

He said his wife’s death is enough for his son to deal with.

”He's got to live with this the rest of his life. Everyone else in the accident does too. There's no reason to charge my son with no second-degree homicide in an accident, Mosley said.
