Cherokee County Man Nicholas Michael Mimms Granted Parental Rights Shot, Killed During Visit at Ex’s Home
CHEROKEE COUNTY, Ga. — A man who had recently been granted parental rights was shot and killed when he arrived at his ex-partner’s home to visit his child, authorities said.
According to the Cherokee County Sheriff’s Office, 31-year-old Eduardo Gilberto Figueroa was shot Saturday afternoon at a residence in Woodstock. Investigators said Figueroa had come to the home to exercise newly established visitation rights.
Deputies said the shooting happened during a confrontation between Figueroa and his ex-partner’s husband, identified as Nicholas Michael Mimms, 37.
Authorities said Mimms fired multiple shots, striking Figueroa. First responders pronounced Figueroa dead at the scene.
Investigators have not released details about what led up to the shooting but confirmed that the incident remains under active investigation. Detectives are reviewing evidence and speaking with witnesses.
Mimms remained at the scene and cooperated with deputies, officials said. It was not immediately clear whether charges will be filed as investigators continue to determine whether the shooting was justified under Georgia law.
Family members of Figueroa said he had recently gone through court proceedings to secure parental rights and had been looking forward to spending time with his child.
The sheriff’s office said additional information will be released as the investigation continues.
