Married womans lover shoots dead her husband - but he WONT be prosecuted because it was self-defense
A man who approached his wife's lover was shot and killed last month, and because of a controversial self defense law, the shooter will not face charges.
Dan Fredenberg went to the Montana home of the man his wife was having an affair with, named Brice Harper, on September 22.
Because the garage door was open, he saw Harper inside and approached him.

That step tued fatal, as Harper then shot Fredenberg three times and, since Fredenberg was on the other man's property, the shooting is being considered an act of self defense.
The New York Times reports that Montana is one of 20 states that has wide-ranging self defense laws that gives homeowners more leverage in justifying their actions against intruders.
This case has many similarities- and a few key differences- between that of Trayvon Martin, the 17-year-old Florida boy who was killed by a neighborhood watchman who used the state's Stand Your Ground defense even though they were on a public road and not on private property.
‘What makes this case different than the others is the victim, according to court documents, had not yet attacked the shooter,’ a supporter wrote on the Facebook page demanding justice for Fredenberg.
‘Deadly force was justified because it was presumed that he would. Under that interpretation, it appears that if you’re at anyone’s home and they assume you will assault them, they can kill you and call it self-defense.’
While the Montana shooter has been cleared of homicide charges, the case is not completely over.
The 40-year-old victim's wife, Heather King-Fredenberg, now has a temporary restratining order against Harper because he allegedly threatened her.
Heather, 22, and Dan met two years earlier, when she became pregnant with twins shortly after they began dating.
They went to Las Vegas for their wedding, and the couple began a tumultuous marriage that was on the rocks at the time of Dan's death.
According to The Times, Heather said that she had not had a sexual been a sexual affair but an emotional one.

Meanwhile, she told a local paper called the Billings Gazette that she and Harper had an affair that lasted about three months and they saw each other two to three times per week.
Two days after the shooting, Heather filed a restraining order against Harper because she said that he threatened her life.
'I fear for my safety/life because of previous threats made prior to him murdering my husband. He has made comments numerous times that he has guns and is not afraid to use them,' he wrote.
